The BBI matter is now in the hands of 7 appellate judges.
Kenyans are anxiously waiting for the hearing so as to know which direction the political class shall turn to, since it also affects them enormously.
Presided by Justice Masinga, the court cession was opened and the third to come in was Justice Gatembu Kairu, that is after justice Tuiyott and Sichale who also had divergent ruling on the matter.
His turn came, a no nonsense face, less smily as he declared the following which was entirely in agreement with high court judges.
He first questioned the quorum of IEBC which in his ruling, did not meet the constitution requirements.
Another issue was the question of the insulation of the president in the BBI popular initiative, he did agree that the president can indeed be charged on his personal capacity.
The question of basic structure doctrine was stressed by the judge, he did side with high court on this together with the ruling of justice Tuiyott.
In summary, the judge is in agreement in entirety by the ruling from the High Court.
