The high Court today declared the Huduma number initiative null and void, saying that the initiative disagrees with the data protection act of 2019.
According to section 31 of the Data Protection Act, data processing should have a data protection impact to access any risk.
Justice Jairus says that no assessment was done before Huduma Number was rolled out.
Huduma number cards have been dispersed to some of the citizens and there is no need to stop the dispersement.
Now that Kenyans details have been captured, the court ordered the government to protect the details.
This is according to a report moved to court by Katiba Institute which stated that Huduma number Initiative did not guarantee data protection. Section 31 of the data protection act had therefore been violated.
The government on the other side denied the report, saying that the act does not apply to their case.
A question that remains in Kenyans minds is that, now that Huduma cards have already been issued to them, what step do they take?
