Quit ODM Team Or Lose Your Job, University Professor Told By The Court

Ben Sihanya, a law professor, has been instructed to choose between lecturing in University of Nairobi lecture rooms and chairing the ODM disciplinary committee.

In August of last year, the intellectual property and constitutional matters instructor was appointed chairperson of the ODM disciplinary committee, a move that the Ethics and Anti-Corruption Commission (EACC) questioned.

Judge went on to say that while a lecturer at a university has academic freedom and is not prohibited from expressing his or her political views, such an official is required to resign if he is appointed or elected to a post in a political party.

"Holding the office of a lecturer at a public university while also holding the appointed office of a chairperson of a disciplinary committee on behalf of a dominant political party equates to engaging in daily or continuous political activities that may be seen to compromise the political neutrality of the office or a lecturer," Justice Nduma said.
