EACC Arrests KPA Finance Manager Over sh214 Million Scandal

Director of Public Prosecution Noordin Haji ordered the arrest of Kenya Ports Authority Finance Manager, Patrick Nyoike, over a sh214 million scandal involving Nyali Capital Limited(NLC).

The arrest was done by Ethics and Anti-Corruption Commission detectives and Mr. Nyoike alongside with two other suspects are being held at Central Police Station in Mombasa. The DPP also recommended the arrest of KPA Clerical Officer Isaac Ombuga, Jacinta Wambugu who is the Nyali Capital Limited General Manager, Alfred Hinga and Peter Ndichu who are two other directors of NLC.

This was after sources from Ethics and Anti-Corruption Commission revealed that Mr.Nyoike used his office to improperly confer the benefit of sh214 million to NCL defining it as a vendor in the KPA portal without authorization. The DPP added that there was no contractual relationship between KPA and NCL yet there were letters from Mr Obunga, KPA's clerical officer ,who defined the company as a vendor in the KPA portal. Mr. Nyoike therefore is being accused of facilitating Nyali Capital Limited to finance KPA suppliers and receive payments directly from KPA. These actions are said to have turned Kenya Ports Authority to a debt collector for monies loaned by NCL to the authority's suppliers. EACC has also noted that all the irregular payments to Nyali Capital Limited were processed by Mr. Obunga. 

Mr Nyoike is also accused of not disclosing that his wife (Jacinta Wambugu) and brother( Alfred Hinga) worked at Nyali Capital Limited, which amounts to a conflict of interest. As a result,these are the charges that the suspects will face; conspiracy to commit an offence, abuse of office, failure to disclose private interest and dealing with suspect property.

Following the resignation of Daniel Manduku as the Managing Director, the agency's General Manager for Engineering, Mr. Rashid Salim had replaced him in an acting capacity. Mr Nyoike had then expressed interest in the position. Patrick Nyoike was among the individuals who were reported to have high chances of taking the mantle at Kenya Ports Authority.However with the charges he is currently faced with, he is less likely to be considered for the position.
