Director of public persecution DPP Noordin Haji has ordered the arrest prosecution of former Kenya Ports authority KPA boss Daniel Manduku over the the irregular attainment amounting to Ksh 244 Million at the states corporation.
Mr Manduku resigned earlier after feeling the heat of the accusers. He was facing charges of unlawfully awarding tenders for the construction of cargo storage facilities at the Nairobi Inland Container Depot (ICD)
Mr Manduku was taken to a Nairobi court early this month together with Mr Kevin Safari who is the commission customs and border control at Kenya Revenue Authority but they were released after Haji refused to rubber stamp the charges against them.
In a statement issued earlier on Thursday, Haji said that the investigation was not clear that the tenders at the inland Container Depot, Kilindini Port and Makongeni goods were shed without an approved budget and procurement plan for the 2018/ 2019 financial year.
"There was no requisition made for concrete barriers by the user Department within the KPA as required under the Public Procurement and Asset Disposal Act, 2015(PP & AD Act, 2015) and the Regulations made thereunder,”
The 10 awarded Companies were hand picked by Manduku which was contradictory to procurement regulations.
