High Court judge Teresia Matheka has reportedly declared being a housewife a fulltime job that should attract some form of compensation.
Ruling in a case where a Ex-wife sought to have his former husband sell all the property they have acquired and to be shared equally, Matheka said that it was very unfair for law to rule that housewives have no significant financial contribution to a family.
In her own thoughts, Matheka said that housewives render fulltime services at home and therefore they should regard themselves as employed and not jobless.
According to her, the weight of ones pockets financially should not be used as a measure for financial evaluation in a marriage.
“It is easy for the spouse working away from home and sending money to lay claim to the whole property purchased and developed with that money by the spouse staying at home and taking of the children and the family. That spouse will be heard saying that the other one was not employed so they did not contribute anything.
To her raising children is a fulltime job. If one can employ a caretaker and pay them to take care of the children, they should do so to their wives.
“Raising children is a full time job that families pay a person to do as well as cooking and cleaning. Hence, for a woman in employment who has to balance child bearing and rearing this contribution must be considered,” she said.
She further pleaded with her fellow members of the jury to put into consideration the 9 months of pregnancy when presiding over cases of matrimonial disputes. She claimed that carrying a pregnancy is equivalent to working.
Rendering her final verdict on the rx-couples disputes, Matheka ruled that the property should be sold, shared equally or one of the party to compensate the other by paying half the value of the property that the party is entitled to.
